1. Agreement to Terms

By accessing or using Tradie Biller ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

2. Description of Service

Tradie Biller provides cloud-based invoicing and business management software specifically designed for Australian tradespeople. The Service includes features for creating invoices, quotes, managing clients, tracking expenses, and generating reports.

3. Account Registration

To use our Service, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your password and account
  • Promptly update your account information if it changes
  • Accept all responsibility for activities that occur under your account

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purposes
  • Upload or transmit viruses or malicious code
  • Attempt to gain unauthorized access to the Service
  • Interfere with or disrupt the Service
  • Copy, modify, or distribute the Service's software
  • Use the Service to send spam or unsolicited communications

5. Payment Terms

Billing: Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law.

Auto-renewal: Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date.

Price Changes: We may change our prices with 30 days' notice. Continued use of the Service after price changes constitutes acceptance of the new prices.

Taxes: All prices are exclusive of GST unless otherwise stated. You are responsible for paying all applicable taxes.

6. Cancellation and Termination

You may cancel your account at any time through your account settings. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period
  • You will not be charged for subsequent periods
  • We will retain your data for 90 days after cancellation
  • After 90 days, your data will be permanently deleted

We reserve the right to suspend or terminate accounts that violate these Terms.

7. Data Ownership and Privacy

Your Data: You retain all rights to the data you upload to Tradie Biller. We claim no ownership over your business data.

Data Use: We will only use your data to provide the Service and as described in our Privacy Policy.

Data Security: We implement industry-standard security measures to protect your data, including encryption and regular backups.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Tradie Biller Pty Ltd and are protected by international copyright, trademark, and other intellectual property laws.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Continuous, uninterrupted, or error-free operation

10. Limitation of Liability

To the maximum extent permitted by law, Tradie Biller shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the Service.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Tradie Biller, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the Service or via email. Continued use of the Service after changes constitutes acceptance of the modified Terms.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Melbourne, Victoria.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tradie Biller regarding the use of the Service.
